FOUNTAIN TIRE – WIN YOUR PURCHASE CONTEST (the “Contest”)

Governed by Canadian Law

BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE TO BE BOUND BY THESE RULES (the “Rules”).

THE CONTEST:

The Fountain Tire Win Your Purchase Contest (the “Contest”) commences at 12:00:01 a.m. Eastern Time (“ET”) on May 16, 2022 and ends at 11:59:59 p.m. ET June 16, 2022 (the “Contest Period”).

SPONSOR:

Fountain Tire/(“Fountain Tire” or “Sponsor”).

ELIGIBILITY:

To be eligible to win, you must be: (i) a legal resident of Canada and (ii) age 19 or older who are residents of the participating Provinces including Alberta, British Columbia/Yukon Territory (combined), Manitoba, Ontario, and Saskatchewan. Employees, representatives and agents/mandataries of the Sponsor, Flexiti Financial Inc. (“Flexiti”) and their respective affiliates, subsidiaries, related companies, advertising and promotional agencies, or anyone domiciled with any of the foregoing are not eligible to enter the Contest. Whether or not any particular person complies with any and/or all of the eligibility requirements will be determined by the Sponsor in its sole and absolute discretion. At request of the Sponsor a selected entrant may be required to provide proof, in a form acceptable to the Sponsor in the Sponsor’s sole discretion, of Canadian residency.

All entries and essays become the property of the Sponsor, and none will be returned.

TO ENTER:

No purchase necessary. There are two methods to enter the Contest during the Contest Period:

Make a purchase at Fountain Tire using a FlexitiCard.

If the winner does not have a FlexitiCard, an account must be opened in his/her name, and once all account opening documentation has been completed and it is confirmed that the winner has fully complied with the Rules and met the eligibility requirements, then the Prize will be applied as a one-time statement credit to that account

Write an original 100-word essay on the subject of “Why You Deserve to Win Your Purchase”. Include your name, phone number, email address, mailing address and signature on the essay, and email to: customer.feedback@fountaintire.com. No photocopied, computer-generated facsimiles, mechanically produced, or mass entries permitted. Original signature of entrant must be on essay and the essay must be an original work of the entrant. Written entries must be received by the Contest Deadline in order to be eligible. Incomplete entries (i.e., Missing information) will be considered invalid.

Entrants may enter the Contest by each method of entry only once, with a limit of two (2) entries per person (i.e., one per entry method set out above). Entries that exceed the limit will be disqualified from the Contest.

If you make a purchase on your FlexitiCard and do not wish to be entered into the Contest, please send an email to: customer.feedback@fountaintire.com informing us that you do not wish to be entered into the “Fountain Tire Win Your Purchase Contest”.

THE DRAW:

On or about June 17, 2022, random draws (one draw per Province based on number of valid entries received for that Province) from all eligible entries to select the names of five (5) potential winners. The odds of being selected depend on the number of eligible entries received for that Province. The Sponsor will contact by: customer.feedback@fountaintire.com only those persons whose names are drawn.

TO WIN:

The selected entrant must email the Sponsor at customer.feedback@fountaintire.com, provided by the Sponsor, within 3 business days of being contacted by the Sponsor. Before being declared a winner, the selected entrant must correctly answer, unaided, a time limited mathematical skill testing question. If the Sponsor is unable to reach the selected entrant within 3 business days or if the selected entrant fails to correctly answer the mathematical skill testing question, the selected entrant will be disqualified, and the Sponsor may select another entrant or entrants for a chance to win. The selected entrant must respond within 3 business days of receipt, complete, sign and return the Sponsor’s declaration of compliance with the Contest rules, a publicity release allowing the Sponsor to use the selected entrant’s name, city/province/territory of residence and/or photograph in advertising or other publicity in connection with the Contest, including print, broadcast or the internet, such as publication on the Fountain Tire or other website(s) of his/her name and the fact that he/she is a Prize winner, disclosure of the fact that he/she is a Flexiti customer, without any payment or other compensation, and a release declaring the Released Parties, as defined below, from any claims or liability relating to the Contest or the Prize.

THE PRIZES:

There are a total of five (5) prizes (each a “Prize”) available to be won. Each Prize consists of up to $1,000 (one-time statement credit applied to the winner’s FlexitiCard on their first purchase).

One (1) winner will be selected from each of the five (5) participating Provinces, including: Alberta, British Columbia/Yukon Territory (combined), Manitoba, Ontario, and Saskatchewan.

The approximate retail value of each Prize is between $1 and a maximum prize value of $1,000 CAD. All amounts outlined in these Rules are in Canadian dollars. Each Prize consists of a one-time statement credit to a Flexiti account that is in good standing and is based on the purchase amount up to a maximum of $1,000. The one-time statement credit will be applied to the first purchase made at Fountain Tire on the winner’s FlexitiCard within the contest period.

If the entrant entered by 100-word essay and no purchase and they are the selected winner, a Fountain Tire gift card of $500 will be provided in lieu of the one-time statement credit to a Flexiti account. No cash value or substitutions permitted.

The Prizes must be accepted as awarded; a Prize cannot be substituted or transferred to a third party. However, Sponsor may in its discretion substitute for any Prize another Prize which is, in Sponsor’s opinion, of equal or greater value. Any additional costs not described in these Rules as part of the Prize that are incurred in collecting and using the Prize are the winner's responsibility.

Maximum one Prize per person.

PRIZE CLAIM DEADLINE:

Prizes must be claimed within three days of being contacted, sometime after June 16, 2022. Any Prize not claimed within three days will not be awarded.

GENERAL:

The Sponsor reserves the right to, without notice, cancel the Contest and award none, some or all of the Prizes for any reason, including, but not limited to, if the Sponsor determines in its sole discretion that an event or cause, including, but not limited to, the loss or destruction of entries, a virus, bug, or computer, electronic or system malfunction, human error, the unavailability of entry methods, or another cause beyond the Sponsor’s control, has impaired the integrity, security, administration or fair play of the Contest. The Sponsor also reserves the right to, without notice, suspend the Contest and/or amend these Contest rules, at any time if the Sponsor, acting in its sole discretion, determines that it must suspend the Contest and/or amend the Contest rules in order to address an impairment or to preserve the integrity of the Contest. If the Contest terminates for any reason before the end of the Contest Period, the Contest Administrator may hold a random draw from all entries received up until the termination date of the Contest to award the Prizes.

Any attempt by any person to undermine the legitimate operation of this Contest may be a violation of criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law, including but not limited to criminal prosecution. The Sponsor's failure to enforce any term of the Contest rules shall not constitute a waiver of that provision.

By entering the Contest, each entrant accepts and agrees to these Rules and all decisions of the Sponsor, which shall be final and legally binding on entrants in all matters relating to the Contest. The Sponsor may disqualify any person who violates the Contest rules.

LIMITATION OF LIABILITY:

The Sponsor, Sponsor’s agencies and Flexiti, including their respective directors, officers, employees, affiliates and other designated agents (the “Released Parties”), assume no responsibility or liability for technical, website, computer, software, hardware or server malfunctions or errors, including, but not limited to, those that may affect the transmission, processing or validation of Contest entries; or for human or technical errors related to the administration of the Contest; or for lost, late, deleted, altered, destroyed, unintelligible/illegible, falsified, damaged, misdirected or incomplete entries, essays, notifications, declaration of compliance and release forms, responses, replies or erroneous winner or potential winner announcements. Released Parties will not be responsible for any incorrect or inaccurate information utilized in the Contest or provided in the Contest rules or Contest advertising. The Released Parties will not be responsible for any damage which occurs to an entrant’s or a third party’s software or hardware from participating in the Contest. The Released Parties make no warranty, guaranty or representation of any kind concerning the Prize and disclaim any implied warranty. Contest entrants forever release and discharge the Released Parties from any and all actions, causes of action, claims, costs and payments for damages, loss, injury, or death, however occurring as a result of participating in the Contest or accepting and using or misusing a Prize in the Contest. By entering the Contest, the entrant agrees to fully indemnify the Released Parties from any and all claims by third parties relating to the entrant’s participation in the Contest or use or misuse of the Prize.

PRIVACY:

By entering this Contest, entrants agree to provide such personal information necessary for the administration of this Contest, which will be used in accordance with Fountain Tire’s and Flexiti’s Privacy Policies found at www.fountaintire.com/privacy-commitment and https://flexiti.com/legal.

The names of the winners may be obtained by writing an email to customer.feedback@fountaintire.com within 120 days after the end of the Contest Period.
